Extension of the competences of notaries and advocates in registering in the commercial register

With effect from the new year, an amendment to Act No. 530/2003 Coll. On the Commercial Register and the Decree of the Ministry of Economy of the Slovak Republic No. 389/2023 on the registration of data in the Commercial Register by the registrar.

Key changes in the position of the notary as registrar

One of the main innovations is the extension of the competences of notaries as registrars authorised to make entries in the Commercial Register. As of 1 January 2025, notaries may not only make initial entries but also changes to the data of persons entered in the Commercial Register.

Limitation of representation of the applicant – notary or lawyer

The new rules also stipulate that the claimant may only be represented by professionally qualified persons – a notary public or a lawyer, or, within the framework of its internal capacities, by its own employee or an employee of a legal entity which is linked to the claimant by property or personnel.

Notary fees for data changes

The notary’s fee for the registration of a change in the registered data of a limited liability company in the Commercial Register is set at 45 EUR, which, together with the reimbursement of out-of-pocket expenses for the Central Information System of the Chamber of Notaries of the Slovak Republic, amounts to 55.90 EUR without VAT (i.e. 68.76  EUR with VAT).
